power saving / hard drive wont sleep in 910

I just got this thing and installed 910.
I am assuming my hard drive never sleeps because of the known issue with 9.10.
And disabling power stuff in the kernal to avoid lockups
Questions:
1 am I right? (Single hdd which I boot off of)
2 any eta on when it will get fixed?
3 should I just install 8.04? (Does it work there?)
